Preventing and countering non-consensual content
The use of non-consensual content, whether it’s real or artificially generated, is a serious issue with both ethical and legal consequences.
This includes things like intimate images, manipulated media such as “deepfakes”, or any explicit content involving a person who did not agree to it.
Any collection, use, reproduction, distribution, or modification of an individual’s image, voice, video, biometric data, or other personal attributes, including but not limited to digital, synthetic, or AI-generated representations, shall require that individual’s prior, explicit, informed, and written consent.
Such consent must be specific as to purpose, scope, duration, and method of use, and shall be freely revocable at any time. Upon revocation, all rights to use shall immediately terminate, and reasonable steps must be taken to cease use and remove existing materials where feasible.
Non-consensual content violates privacy and autonomy.
People have the right to control how their image, voice and identity are represented. Victims often experience emotional distress, reputational damage, harassment, or worse.
Even AI-generated or edited content can damage someone’s life if it appears believable.
Victims of impersonation frequently delay seeking medical or legal assistance, which can accelerate potential harm.
A proper legal case assessment is crucial for determining the right strategy and approach.
